General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise their right of withdrawal;
Consumer: the natural person who is not acting for purposes relating to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur;
Day: calendar day;
Long-term transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;
Means of distance communication: any means that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time;
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 2 – Applicability

These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the General Terms and Conditions can be inspected and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, the text of these General Terms and Conditions may be provided electronically in such a way that it can be stored easily on a durable data carrier.

If any provision of these General Terms and Conditions is null and void or annulled, the remaining provisions will remain in full force and effect.

Situations not covered by these General Terms and Conditions shall be assessed in accordance with the spirit of these General Terms and Conditions.

Article 3 – The Offer

If an offer has a limited validity or is subject to conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. Images are a truthful representation of the products. Obvious errors or mistakes do not bind the entrepreneur.

All images and specifications are indicative and cannot give rise to compensation or dissolution of the agreement.

The following information will be clearly stated in the offer:

  • The price (excluding customs clearance fees and import VAT, if applicable)

  • Possible shipping costs

  • The method of payment, delivery, and performance

  • Whether the right of withdrawal applies

  • The duration of acceptance of the offer

  • Available sizes, colors, and materials (if applicable)

Article 4 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set forth.

If the agreement is concluded electronically, the entrepreneur will confirm receipt of acceptance electronically.

The entrepreneur will take appropriate technical and organizational measures to secure electronic data transmission.

The entrepreneur may investigate whether the consumer can meet their payment obligations and may refuse an order if justified.

The agreement is subject to sufficient product availability.

Article 5 – Right of Withdrawal

When purchasing products, the consumer has the right to withdraw from the agreement within 30 days without giving reasons.

The cooling-off period starts on the day after the consumer receives the product.

During this period, the consumer must handle the product and packaging with care. If exercising the right of withdrawal, the product must be returned in its original condition and packaging where reasonably possible.

The consumer must notify the entrepreneur in writing (email) within 30 days of receipt if they wish to exercise the right of withdrawal.

After notification, the consumer must return the product within 30 days. Proof of return shipment must be provided.

If the consumer does not notify within the stated period, the purchase becomes final.

Article 6 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are borne by the consumer.

If payment has been made, the entrepreneur will refund the amount as soon as possible, but no later than 30 days after withdrawal, provided the returned product has been received or proof of shipment has been supplied.

Article 7 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:

  • Custom-made products

  • Personal items

  • Products that cannot be returned due to their nature

  • Products that deteriorate quickly

  • Sealed hygiene products once opened

Article 8 – The Price

Prices will not be increased during the validity period stated in the offer, except due to VAT changes.

All prices are subject to typographical errors. The entrepreneur is not liable for pricing errors.

If goods are shipped from outside the EU, import VAT and customs clearance fees may apply and are the responsibility of the customer.

Article 10 – Conformity and Warranty

The entrepreneur guarantees that products comply with the agreement and applicable legal requirements.

Defects must be reported within 30 days of delivery.

Warranty does not apply if products have been modified, misused, or improperly handled.

Article 11 – Delivery and Performance

Delivery will be made to the address provided by the consumer.

Orders will be executed within 30 days unless otherwise agreed.

If delivery is delayed or partially impossible, the consumer will be informed and may cancel the agreement free of charge.

Risk of damage passes to the consumer upon delivery.

Article 12 – Duration Transactions

The consumer may terminate long-term agreements with a notice period of no more than one month.

Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days.

The consumer must immediately report inaccuracies in payment details.

Article 14 – Complaints Procedure

Complaints must be submitted in writing within 7 days of discovering the defect.

Complaints will be answered within 30 days.

Article 15 – Disputes

All agreements are governed exclusively by Dutch law.

Article 16 – CESOP

Due to regulations implemented from 2024 under EU payment legislation, payment service providers may register transaction data in the European CESOP system.
